TCPA Consent and E-Consent

The checkbox on the request form is short. This page is the long version: what it allows, what it doesn't, and how to take it back.

The Consent You Give

By submitting your request, you agree to be contacted by American Emergency Funds and its lending partners by phone, text message, and email, including through automated or prerecorded technology, at the number and address you provide, even if it is on a do-not-call list. Consent is not a condition of any purchase. You can opt out at any time by following the instructions in any message you receive.

The Telephone Consumer Protection Act (TCPA) is the federal law that governs marketing calls and texts. It requires your express written consent before a business can contact you using an automatic telephone dialing system or an artificial or prerecorded voice. Ticking the box on our form and submitting your request is that consent, and it's recorded with the date, time, and the phone number you gave us.

What That Means in Plain Terms

  • Who may contact you: American Emergency Funds, and the lenders and lending partners in our network who receive your request.
  • How: phone calls, SMS text messages, and email, including calls and texts placed with an autodialer and messages using a prerecorded or artificial voice.
  • Where: the phone number and email address you provide, including a mobile number, and even if that number is on a federal, state, or company do-not-call list.
  • About what: your request, offers that may be available to you, and related marketing.
  • Frequency: message frequency varies. Standard message and data rates from your carrier may apply.

Consent Is Not a Condition of Purchase

You don't have to agree to marketing contact in order to buy anything, and no lender can require it as a condition of a loan. That said, the request form needs the consent to work, because sharing your request with lenders who may then contact you is the service. If you'd rather not be contacted, the honest answer is not to submit the form.

How to Revoke Consent

You can withdraw this consent at any time, and it takes effect for future contact from us. Any of these works:

  • Text: reply STOP to any message. Reply HELP for help.
  • Phone: tell the caller you want to be removed.
  • Email: use the unsubscribe link, or write to [email protected].
  • Web: send a note through the contact form.

Lenders you've already been connected with are separate businesses. Revoking consent with us doesn't automatically revoke it with them, so follow the opt-out instructions in their messages as well.

Electronic Communications Consent (E-SIGN)

By using this website and submitting a request, you consent under the federal E-SIGN Act to receive all communications, agreements, disclosures, notices, and other information from American Emergency Funds and the lenders and lending partners we connect you with in electronic form, including by email, by text message, and by posting on this website, instead of on paper. This consent covers this Privacy Policy, our Terms and Conditions, the consent and TCPA disclosures, and any documents related to your request. To access and keep electronic communications you need a device with internet access, a current web browser, and a valid email address, and you are responsible for keeping your contact details current. Standard message and data rates may apply to text messages, and you can stop texts at any time by replying STOP. You may withdraw this consent or request a free paper copy of any disclosure at any time through our contact form, though doing so may mean we can no longer provide the matching service.
